EC Roberts Armed and Safe News =========================================================== ASSEMBLY DAILY FILE COMMITTEE HEARINGS TUESDAY, JULY 11, 1995 PUBLIC SAFETY 9 a.m.-Room 126 Measure: Author: Summary: S.B. No. 557 Campbell. Firearms. This bill changes the definition of firearms which may not be carried concealed to include those with barrels of any length. Presently the law covers barrel lengths up to 16 inches. This bill would also eliminate the felony of possession of a firearm by anyone previously convicted of two or more "brandishing" misdemeanors. This bill would toughen sentences imposed for carrying concealed by persons prohibited from possessing firearms. (The part adding any length gun barrel is a bit troublesome, as there are other bills in the hopper which use this definition to prohibit certain acts. For an example, go to the last page and read the bullet ban proposed in AB-99. Increased penalties for convicted felons carrying concealed doesn't bother me. -ecr) S.B. No. 670 Lewis. Firearms: dealers' record of sale. This bill would prohibit DOJ from charging a DROS fee in excess of $14. The bill also would require the Bureau of State Audits to conduct an audit of the DROS Special Account in the General Fund. S.B. No. 671 Lewis. Firearms: dealers' record of sale. This bill would set forth procedures for the electronic or telephonic transfer of DROS information for handguns and concealable firearms. (These two bills appear to be good bills. -ecr) S.B. No. 693 Lockyer. Weapons. This is Senator Lockyer's annual attempt to make sense out of the messy gun laws on the books. All it does is gather all existing laws covering firearms and destructive devices into one place in the law books and put them in some semblance of order. Previous versions of this bill have been passed and vetoed by the Governor, under pressure from DOJ. (I think this is a good idea whose time has come. It is time to gather these laws together in the books, so we can see just what crap the legislature has imposed on us. -ecr) FOR VOTE ONLY A.B. No. 638 Knight. Concealed weapons licenses. This bill would require the issuance of a license, within 15 days of receipt of the Department of Justice's report of all data and information pertaining to the applicant, upon proof that the applicant is a resident of the county, is 21 years of age or older, desires legal means to carry a concealed weapon for lawful self-defense, and demonstrates competence with a firearm, as specified. (This is the Knight-Montieth Citizen Self-Defense Act, which would bring California into line with several other states which have passed a Florida-style CCW law this year. CALL! FAX! Bend some ears and tell your hired hands this bill must pass. -ecr) WATER, PARKS AND WILDLIFE CORTESE, Chairman 9 a.m.-Room 444 Measure: Author: Summary: S.B. No. 28 Leslie. Wildlife: mountain lions. This bill authorizes the Fish and Game Commission and the Department of Fish and Game, upon approval of the voters, to regulate and manage mountain lions in the same manner as it regulates and manages mammals that are not rare, endangered, or threatened species. Requires the department to prepare a mountain lion management plan. (Perhaps we can return to the days when these predators understood that Man is the top of the food chain, not some place lower. -ecr) =========================================================== SENATE DAILY FILE COMMITTEE HEARINGS MONDAY, JULY 10, 1995 APPROPRIATIONS JOHNSTON, Chairman 9 a.m.-Room 112 (Please note room change) A.B. No. 70 Willard Murray. Firearms: curios or relics. This bill would recast provisions prohibiting carrying concealed firearms, adding to the list of exempt acts the possession or transportation of any unloaded curio or relic firearm. This bill would also remove the dealer's restrictions and reporting requirements concerning curio or relic firearms. It would add the requirement that the purchaser's Basic Firearms Safety Certificate number be added to the information included on the DROS. (This bill relaxes the restrictions on firearms which are curios and relics. -ecr) TUESDAY, JULY 11, 1995 CRIMINAL PROCEDURE MARKS, Chair 8 a.m.-Room 2040 (Please note time and room change) BILLS WILL BE HEARD IN ORDER OF FILE. A.B. No. 132 Battin. Firearms: assault weapons. This bill would modify the list of designated firearms defined as assault weapons. It would remove from the list some firearms which do not exist, and clarify the inclusion of the SKS built to take the AK magazines. (This bill is OK, although I would rather see all the guns removed from this list. -ecr) A.B. No. 547 Davis. Firearms. This bill would strengthen the prohibition of parole for anyone convicted of a major violent crime with a firearm. (Do the crime, do the time. -ecr) A.B. No. 1305 Bowler. Game: shotguns. This bill would clarify the law against possession of a shotgun larger than 10 gauge or capable of holding more than 6 rounds while hunting. Apparently, some LEOs were arresting people for owning these shotguns, even though they were not using them for hunting. (Anything which prevents harassment of law-abiding gun owners by over-zealous cops is good in my book. -ecr) A.B. No. 1908 Bowler. Weapons: stun guns. This bill makes it legal for law abiding citizens to defend themselves with remote stun guns. Manufactures would be required to apply serial numbers to the devices and include instructions and practice targets. Manufactures would have to maintain records on purchasers and make those records available to law enforcement agencies upon request. (This bill makes some sense, as it removes the "taser" from the prohibited list and allows use of remote stun guns for self defense. -ecr) ======================================================== SENATE DAILY FILE - SCHEDULED FLOOR ACTIONS UNFINISHED BUSINESS S.B. No. 23-Peace. An act relating to weapons. (Final vote in the Senate: AYES-39. NOES-0.) July. 6-Concurrence in Assembly amendments pending. This bill would add to the list of misdemeanors which would prohibit firearm possession for 10 years after conviction. It would also allow a dealer to deliver firearms at a place other than the address shown on the dealer's license. (The misdemeanors which would be added to the list are ones which should restrict the future possession of firearms, in my opinion. I also think a dealer should be allowed to deliver goods other than at his store front. -ecr) ASSEMBLY BILLS-THIRD READING FILE A.B. No. 633-Lee et al. (Petris) An act relating to weapons. Vote required: 21 June 12-From Consent Calendar to third reading. On motion of Senator Russell. June 15, 19, 22, 29, July 3, 6-Passed on file. This bill mandates that firearms surrendered to law enforcement be destroyed, rather than sold to licensed dealers. (A lot of good guns are going to be melted down if this passes. It is up to the third reading, so it can be on its way to the Governor at any time. Remember, call your Senator on this Assembly bill. -ecr) A.B. No. 99-Burton. (Kopp) An act relating to firearms. Vote required: 21 June 12-Read second time. To third reading. June 15, 19, 22, 29, July 3, 6-Passed on file. This bill would redefine handgun ammo as ammunition principally for use in pistols and revolvers AND OTHER FIREARMS CAPABLE OF BEING CONCEALED UPON THE PERSON. (My 30-06 Mauser is "capable" of being concealed on my person. I might walk a little funny, but it would be concealed. Remember, they have a bill in the works to include all guns in the definition of "capable of being concealed." -ecr) ================================================================ The latest Armed and Safe, Volume 2, Number 4 is in the shops. I expect to have the text version uploaded to internet and the bulletin boards later this week. {end} It goes on to state: "Handgun ammunition designed primarily to penetrate metal or armor" means any ammunition, except a shotgun shell or ammunition primarily designed for use in rifles, that is designed primarily to penetrate a body vest or body shield, and has either of the following characteristics: (1) Has projectile or projectile core constructed entirely, excluding the presence of traces of other substances, from one or a combination of tungsten alloys, steel, iron, brass, beryllium copper, or depleted uranium, or any equivalent material of similar density or hardness.
