Governor Gray Davis State Capitol Building Sacramento, CA 95814 Re: AB35 and SB52 - Gun Licensing Legislation Dear Gov. Davis: Let me preface my comments by saying that I don't own any handguns, am not a member of the NRA, was born and raised in California and have been a registered Democrat since the age of 18 (I am now 45). Over the past several years, I have watched with growing alarm as the Democratic Party in this state has moved to restrict the access of law-abiding citizens to firearms. With the above- referenced legislation, they wish to make it even more difficult and expensive for citizens to purchase items which they have right, not a privilege, to own. I am aware of the many court decisions that have upheld the plethora of gun control laws put on the books in recent years. Sadly, the Ninth Circuit Court of Appeals has opined that Californians do not even have a Second Amendment right to individual gun ownership. Most citizens are blissfully ignorant that this right has been stripped from them by our courts. I would expect that if our First Amendment rights were given similar treatment by the judiciary, the outcry would be immediate, both from the public and other branches of government. It is probably because citizens like myself have remained silent in the face of this assault on our constitutional rights that the legislature and the courts have felt emboldened to proceed with their unrelenting campaign to deprive us entirely of our Second Amendment rights. But, I have resolved to remain silent no longer. From this day forward, I will not vote for any Democratic Party candidate who supports further gun control efforts. In fact, I will work affirmatively to defeat them and will work, as well, for the repeal of existing gun control laws. My efforts will also be directed at informing family, friends and the general public that their constitutional rights have been taken away by the courts. I read today that you are still "cool" toward the passage of AB35 and SB52, or any new gun control measures, until those on the books are given a chance to work. I would urge you to veto this legislation should it be sent to your desk. My vote, and the vote of many of my democratic friends, will depend on it. Yours respectfully, Dan W. Gordon
