The association exists to promote the exchange of information and ideas, to study diverse strategies and to foser fellowship.) *********************************************************************** ***** EDITORIAL ******************************************************* *********************************************************************** First let me welcome the 300+ new members who have joined ISIL in the past few months as a result of a recent mailing of the Freedom Network News to the U.S. Libertarian Party list. We would like to thank you for the many very kind remarks you sent us about our work and particularly those regarding our "New Declaration of Independence." CONSTITUTIONAL REFORM . . . Response to our call for political reform in the summer "Constitutional Change" issue of the Freedom Network News has been enthusiastic and ISIL has been contacted by numerous individuals representing groups proposing one kind of reform or another. We were even upstaged by Mr. Karlheinz Halter of California who has drafted a "Declaration of War" on Congress. We have also been in touch with Doug Buchanan of the Alaska Independence Movement. He has drafted a hard-hitting Declaration of Independence for Alaskans. There were many more, representing a groundswell of outrage and angry protest. We will report on some of these next issue. It seems that no one likes Washington, DC anymore. As a matter of fact the current conditions bear a stark similarity to those surrounding the original American Revolution -- with distant, unfeeling bureaucracies taxing, regulating and harassing the people into a state of abject serfdom. We have received a considerable amount of commentary on ways to prevent America from going the way of the Soviet Union. In this regard, many people remarked that they had grave reservations about the article in the New Declaration calling for a Constitutional Convention to amend the Bill of Rights. I have to agree with Jarret Wollstein who remarked candidly that, given the current statist mind-set of Americans today, "the people are much more likely to ratify the Communist Manifesto than an improved Bill of Rights." The question now confronting "we the people" is how we may bring our political institutions under some semblance of control before the economy is completely destroyed and bloody revolution breaks out. Its important to note as Bumper Hornberger of the Future of Freedom Foundation has observed, if we cant effectively defend freedom and roll back tyranny in America with our great heritage of liberty and a massively armed populace there is absolutely no hope for the rest of the world. America will rise or fall depending upon the peaceful pioneering work being done by libertarians and their allies today. Perhaps we should lobby to institute a "Citizens Veto" as suggested by Jim Peron in the last newsletter. This would at least allow people to kill or repeal bad legislation -- or peacefully remove corrupt politicians from power. The proportional electoral system used in much of Europe and now being adopted by New Zealand (see news items in this issue) might also be a solution. It would help break the monopoly of power in Congress and allow people with fresh new ideas (like the Libertarians) to influence the political debate. Needless to say, none of these provide any panacea -- the ultimate solution being a much better educated and informed public. In this regard Im afraid we have a long and difficult road ahead of us. *********************************************************************** ***** NEW I.S.I.L. PAMPHLETS ****************************************** *********************************************************************** While on the subject of educating the public, we have enclosed complimentary copies of three new ISIL educational pamphlets: The New Declaration of Independence by Jarret and me; Jobs For Everyone -- Without Minimum Wage Laws by Australian libertarian party founder Mark Tier (this piece also appeared in a recent issue of LIBERTY magazine); and The Looting of America: Civil Asset Forfeiture by the modern movements "Thomas Paine," Jarret Wollstein. (ISIL-NET users see our literature file). These pamphlets (there are 20 now) are proving to be an extremely popular and effective way to spread libertarian ideas. Individuals, Libertarian party groups across America, as well as student chapters, community organizations, etc. have been ordering these in unprecedented quantities. In July and August we shipped close to 130,000 pieces. Doctors and dentists have called to say that they have been placing them in their waiting rooms. Even Democrats have been circulating thousands of our "Ending Our Drug Nightmare" paper. Pre-production copies of the "Looting of America" pamphlet went over very well when distributed at the recent NORML national conference in San Francisco. This was largely a Liberal crowd. ISIL papers have also been translated and published in other countries. The "Free Trade" and "Privatization" pamphlets -- and Don Ernsberger's critique of the "Labor Theory of Value" have been published in Romanian and Polish newspapers and six pamphlets have been translated into Portuguese and reprinted in Brazil by ISIL Student Chapter organizer Eduardo Gomes. We urge you to use these personally to influence your friends, neighbors and acqaintances and if you are with an LP or other political group, use them as an educational adjunct to your political efforts. Same price of 5 cents apiece. *********************************************************************** ***** POPRAD, CZECHOSLOVAKIA CONFERENCE REPORT ************************ *********************************************************************** I would like to touch lightly on the outcome of our world conference in Poprad, Czechoslovakia. This event drew 100 individuals from 23 different countries -- including most of the Central and Eastern European countries, Canada and the U.S.A., Europe, Argentina, and even Nepal. It was the first time that we had been able to interact with such a large group of people from behind what used to be the Iron Curtain. There were very very high energy levels and an exhilarating feeling of camaraderie that grew as the conference advanced. It was indeed a very exciting and fulfilling time for everyone. ISIL, thanks to the generosity of you our members, provided complimentary copies of two books: "Better Government at Half The Price" and Rothbards "The Case For the 100% Gold Dollar" for all participants from Central and Eastern Europe. Some highlights, aside from the very large amount of networking that occurred at the conference, included Frances Kendall's unscheduled speech on the differences between men and women (psychological and genetic) -- and what it means to the libertarian movement (tape available through Freedoms Forum Books). This talk, the subject of a new book being written by Frances, was an enormous hit. Much excitement was also generated by the announcement by Leon Louw that he had been retained to do a complete restructuring in Irkutsk, Eastern Siberia. According to Louw, they have had to start from scratch as there is virtually no infrastructure -- physical or legal -- to build upon. This project is to include training videos on business law, and the design of contract forms, etc in Russian. We were honored by a visit by Janusz Korwin Mikke, a libertarian member of the Polish Parliament and founder of STANCZYK -- Poland's classical liberal magazine (which was an underground publication during the communist years). Several ISIL members including Glenn Cripe, Camille Castorina, and Ken Schoolland visited Mikke's office in the parliament buildings in Warsaw. We also had several people from the Slovakian Ministry of the Economy, including Jan Oravec of the newly formed F.A. Hayek Foundation in Bratislava. ISIL member Tom Grey, now Chief Advisor to the minister of the Economy in Bratislava, spoke in what seemed to be almost apologetic tones of the seemingly insurmountable problems and compromises he faced in trying to foment change in Slovakia. Of particular interest was a panel of businessmen from Poland, Czechoslovakia, and Lithuania -- moderated by Barbara Sall of Idaho. Their problems were much like those of Americans -- high taxes (a 38% social security tax and a 24% VAT in Poland!!) and huge bureaucracies crippling the abilities of small businesses to perform. A full report on this conference by Glenn Cripe will appear in the special fall issue of the Freedom Network News. *********************************************************************** ***** LIBERTARIAN ACTIVITIES IN SCANDINAVIA AND RUSSIA **************** *********************************************************************** By Ken Schoolland Following the Poprad conference I met with several leaders of the Progress Party in Denmark. One, a current member of Parliament, showed us all around the official chambers, describing in detail the successes and methods of the movement. They now have 12 seats out of a total of 179 in Parliament and true libertarians are in the leadership, writing books and routinely dominating TV appearances. The difference with their approach is that at first they havent advocated hardcore Libertarian programs to the public -- so they have received a broader support-base of members. Libertarians, however, remain in the leadership. In Denmark the Progress Party is the 2nd largest party, now getting 20% of popular support in the polls, among a total of 8 parties. The system of proportional representation, rather than the winner-take-all system in the U.S., makes a big difference both in recognition and legitimacy for a new movement. They informed me that the percentage of votes won by Libertarians in Hawaii in the last elections would have qualified them for 6 or 7 seats under the Danish system. Norway's Progress Party has experienced almost a parallel development. Denmarks party started a year after the U.S. Libertarian Party was founded (1971) in 1972 and Norways a year later in 1973. Both started as anti-tax movements and broadened from there. They suffered a backlash when they developed a reputation for being anti-immigration and racist because they wanted to cut off government welfare for immigrants. In Denmark, the parliament actually passed a law on taxes that applied retroactively to the party leader, Mogens Glistrup, and they put him in jail. The partys popularity sank to a low of 1% in 1985 but has made a strong comeback in recent years due to a new leadership that stresses free market principles. In fact, the Danish party recently used their swing-vote leverage on a crucial vote to gain approval for 10 free enterprise zones in the country. The Party in Norway now has 24 seats in Parliament, with a high of 24% in the polls in 1988. This, oddly enough, entitles them to government funds to promote their Party, which they accept because they feel they can use it to counter the much greater funding of the Socialist and Conservative (also socialist) parties. So they have staff and researchers and publications along with diligent, positive, and disciplined professionals. On my travels, I spent a considerable amount of time getting to know William Milonoff, a member of the Free Democratic Party of Russia. Milonoff, International Liaison Officer of the Party, is a member of ISIL and is anxious to network with our members. He describes the Free Democratic Party as ``the party with the Libertarian and Classical Liberal ideas. The party has 3500 members -- 1000 in St Petersburg where it is the largest single party in the existing local government. Many individuals in the leadership are pure libertarians and the party philosophy is the closest thing to the Libertarian Party in the U.S. William tells me that they are in desperate need of literature, money, and used computer equipment . . . all in acutely short supply in Russia. He spoke at the Poprad conference and has been on an extended trip throughout Eastern Europe expanding ISILs member network. *********************************************************************** ***** HELP NEEDED BY ISIL REP IN ROMANIA ****************************** *********************************************************************** Valentina Buxar, ISIL Representative in Romania, has been translating classical liberal works into Romanian by hand for Daniel Stancu at the Liberty Institute in Bucharest. This is a hideously laborious and time-consuming task and she asked us if ISIL members could help find a PC for her to help speed up the process. The Institute, incidentally, was set up with the assistance of Tom Palmer of the Institute for Humane Studies (IHS). Both Valentina and Daniel attended the Poprad conference. *********************************************************************** ***** I.S.I.L. CHAPTER FORMED IN BELGRADE, YUGOSLAVIA ***************** *********************************************************************** Following Poprad, Mr. Tomislav Krsmanovic and Mr. Dusan Pokorni have formed a core ISIL group in Belgrade to promote a peaceful (Louw/Kendall-styled) solution in Yugoslavia. Krsmanovic is president of the Belgrade-based Organization for Human Rights. The group he has assembled includes a psychologist, an economist, and a news director with Radio Belgrade. They are Serbian, but Krsmanovic is attempting to bring in members from Macedonia and Montenegro. He has asked if our members can help him get a fax machine to facilitate communications with ISIL HQ. Donations are of course tax deductible in the US. Unfortunately, due to the U.N. embargo, we are currently unable to communicate via the mails. We are hoping that an early shipment of books (Let the People Govern, The Heart of the Nation, etc) got through before the embargo was imposed. *********************************************************************** ***** WORLDWIDE MOVEMENT TOWARD PROPORTIONAL REPRESENTATION *********** *********************************************************************** In September two-thirds of the eligible voters in New Zealand turned out to reject their U.S.-styled plurality voting system by a stunning margin of 85% to 15%. In the second part of the remarkable national referendum -- the only item on the ballot and the first of any kind in New Zealand since 1966 -- 70% chose the German-style "mixed member" proportional representation system as their preferred alternative voting system among options. Almost all of the worlds democracies use forms of proportional representation (PR). Voters now are scheduled to make a binding choice between the plurality system and mixed member PR system in 1993. However, representatives of the victorious New Zealand Electoral Reform Coalition argue that todays overwhelming results demand immediate action by the government to adopt mixed member PR. PR also is under serious consideration for Canadas federal senate, which will be elected for the first time if Canadians approve proposed constitutional reforms. If New Zealand and Canada adopt PR, the only well-established democracies left using the U.S. system will be India and Britain, and in Britain polls show a majority supports PR. Citizens for Proportional Representation president Matthew Cossolotto commented, "There are compelling reasons why other countries reject our system. They graduate two out of every five students with seventh grade skills and produce failure rates in the 60% range. It has become a socialist bureaucratic monstrosity that wastes billions of tax dollars and features 125 "education" bureaucrat-drones for every 100 teachers. A popular movement in the USA today is attempting to wrest some power away from the bureaucrats back to the education consumers -- the parents. This interim measure to introduce an element of choice in the spending of education tax dollars is via a "voucher system." Not unexpectedly, the voucher system idea has been viciously attacked by the educational establishment -- particularly by the teachers unions who have gone so far as to establish telephone hot-lines to alert unions of the activities of pro-voucher people so they can send out goon-squads to harass and intimidate petitioners. Teachers have also been sending anti-voucher propaganda home with the children (an illegal practice). I.S.I.L. member J.G. "Mike" Ford reports the following: A major breakthrough on the issue of school choice has happened. Voters in two states have, through the initiative process, gathered over one million signatures (California 928,000 and Colorado 91,000) to place the issue on the ballot. Each initiative provides for parental choice at both public and private schools, with vouchers at 50% of what taxpayers pay per child. The vote in California will be in June 1994; but in Colorado it will be November 3rd this year. If it passes in Colorado, then in 1994 we should expect similar school choice proposals to be on the ballot in ten additional states -- much the way term limits for legislators spread from Colorado to California ballots in 1990 to ballots in fifteen other states by 1992. Cruise Convention, very few actual registrations were received. So few, in fact, that the Cruise Line would not guarantee us space. It may be the bad economy -- or the fact that many libertarians tend to leave registrations to the last minute. We would like to do this again. We have, for example, been offered a very attractive deal for a Hawaiian tour -- but members must realize that to qualify for these very low rates, the travel people expect full payment and a reasonable number of registrations -- usually 60 days in advance. ********************************************************************** ***** RED ALERT: THE RISING AMERICAN POLICE STATE ******************** ********************************************************************** By Jarret Wollstein During the last few decades, a tidal wave of authoritarian legislation has been battering America. Little by little, our freedom and our economic security are being destroyed. Here are just a few examples: * In January, 1992, the city government of Washington, D.C. passed legislation making gun manufacturers civilly liable for massive damages if any person (other than a government agent) uses one of their guns to cause bodily harm. If this law withstands legal challenges, most U.S. firearms manufacturers could be bankrupted within a few years by damage claims just from Washington, D.C. (which is the murder capital of America). Undoubtedly many other jurisdictions will adopt similar laws if D.C.s manufacturer liability law is upheld. * On September 1, 1992, 1600 pages of new Department of Health and Human Services regulations went into effect. Among other things, these regulations banned most medical testing by doctors in their own offices. These new regulations will dramatically increase the cost of health care, greatly delay test results, and create a new class of crimes for physicians. * During the summer of 1992, the school board of Montgomery County, Maryland introduced new "sexual harassment" rules which would require principals to discipline or expel students accused of (among other things) "unwanted flirtations" and "graphic or verbal comments about an individuals body or dress." Under these rules, if someone takes offense at your smiling at them or saying "thats a lovely dress", you would be subject to punishment. Around the country, other sexual harassment and stalking laws prohibit telling dirty jokes, repeatedly asking someone for a date, or walking behind them. In some states you now can be imprisoned without trial if someone simply accuses you (without independent corroboration) of "stalking". Such laws are placing the most minute details of our personal lives under government control. * In Michigan, legislation is now pending giving police "no-knock waivers", allowing armed SWAT teams to break down doors and enter homes without any advance warning. As John Dentinger documented in his PLAYBOY article "Narc, Narc", thousands of Americans nationwide are now being terrorized, beaten and even killed in their own homes as a result of police drug raids at the wrong house. * One-fourth of our nations elementary and junior high schools now have DARE programs (Drug Abuse Resistance Education). During these 17-week courses, uniformed police officers teach children the official government line on drugs. Correct answers to policemens questions are rewarded with small gifts and candy. Instructors encourage children to call police and turn in their parents and friends "for their own good," if they see them using drugs. What police don't tell children is that if they turn their parents in, their parents will be immediately arrested, the children may be placed in foster care, and their homes can be confiscated under civil forfeiture laws. The exact content of DARE is secret. Instructors refuse to let parents see teaching manuals or sit in on classes. Another particularly disturbing trend is the rapid expansion of local, state and federal civil asset forfeiture laws. In complete defiance of the Bill of Rights, these laws enable government agencies to confiscate cash, cars, homes and businesses without indictment, trial or conviction. Totally innocent people and others accused of minor offenses, are losing everything they own. In the last 3 years, police in Volusia County, Florida (near Disney World) have seized over $8 million in cash and property from motorists stopped for minor traffic violations (Orlando Sentinel, 8/12/92). In New York City alone, 10,000 cars a year are seized and sold by the city, which keeps the revenue. Nationwide, government seizures are now doubling every year. Over $644 million in property was seized in 1991, and over $1.2 billion will be seized this year. Once property is seized by the government, it is virtually impossible to get it back. Every Constitutional defense against asset forfeiture is being abolished. Recently the "Justice" Department has taken the position that once an illegal act occurs on some property (for example, if someone sells drugs in an apartment building, hotel or restaurant), that property belongs to the government from the moment of the illegal act, even if the owners knew nothing about it and had no involvement with the "crime" (U.S. v. 92 Buena Vista Avenue, Rumson, NJ. No. 91-781). See ISILs new issue paper "The Looting of America" for more details on civil asset forfeiture. The rate at which totalitarian legislation is being introduced and passed is truly mind-boggling. Pending federal laws include: -- HR 1790 which would prohibit the manufacture or sale of most independent replacement parts for cars, appliances or furniture (car repair costs alone could triple); -- The 1992 Omnibus Crime Bill, which lists 52 acts requiring a federal death penalty, including mailing an undefined "injurious device"; and -- The Arctic Penitentiary Act which mandates the establishment of a U.S. prison camp (gulag) above the Arctic Circle for drug users and sellers. Laws now being passed in the U.S. closely parallel those enacted by Adolph Hitler during the early years of his rule: Banning of firearms, confiscation of property without due process, and the establishment of ``shock incarceration centers. With millions of laws now on the books, there is not a single person in America who hasnt broken some of them. In 1991 alone, the Federal Register published 67,715 pages of new federal laws and regulations each of us is required to obey. This is in addition to over one million pages of laws and regulations already enacted. (Remember, ignorance of the law is no excuse!). Anyone in the U.S. can now be legally accused of a crime, "detained" in jail for months or years without trial, and have all of their property summarily confiscated by the government based upon mere accusation. While politicians argue about details, the great majority of our political "leaders" support the substance of these authoritarian laws -- including George Bush, Bill Clinton, Ross Perot, and most members of Congress and state legislatures. Totalitarian legislation is also supported by most federal judges, 80% of whom were appointed by Reagan or Bush. So regardless of who wins in November, we can expect legislatures to pass and courts to uphold more and more authoritarian laws. Incredibly most Americans remain totally unaware of how government has destroyed their economic security, and how few rights they have left. (The establishment media and government schools certainly dont tell them!) And when most Americans become aware, they feel too isolated, weak, or afraid even to protest, much less to effectively fight back. If the modern libertarian movement is to serve any serious purpose in this country, in this century, we have to get very busy and very serious right now about stopping the emerging American police state. So long as you live in the U.S. you really only have three options: You can join the oppressors or try to become one of their buddies. You can meekly submit and hope you don't get unlucky or offend anyone in power. Or you can fight back. I have these suggestions for everyone who wants to fight for freedom: FIRST: Educate yourself about new and pending laws. Even I found it hard to believe how vicious and totalitarian some of the new laws are. Newsletters published by the ACLU, People for the American Way, the Criminal Justice Policy Foundation, FEAR (Forfeiture Endangers American Rights), Families Against Mandatory Minimums, The Drug Policy Foundation, and other groups clearly report new and pending laws. (See "The Looting of America" pamphlet for addresses of these organizations). SECOND: Inform others. Start with issues on which you will get substantial public support. The vast majority of Americans dont endorse confiscation of the assets of innocent people, banning independently manufactured auto replacement parts, and prohibiting doctors from performing tests in their offices. Each of us can make a tremendous difference by talking to our friends, writing and faxing legislators (state legislators in particular usually get very little mail), getting on local talk shows, starting letter-writing clubs, and so forth. Finally provide all the support you can for groups like the Libertarian Party, ISIL, and FEAR. These groups are doing vitally important work and are are worthy of your support. Americans today are very upset about rising crime and our failing economy. They are disgusted by politics as usual and are searching for answers to our social problems -- but they dont know which way to turn. This creates a tremendous opportunity for libertarians. Libertarians have the answers, but lamentably we frequently offend rather than persuade.
